  • Chapter 7: The most familiar form of bankruptcy, Chapter 7 allows you to eliminate most of your debts, which in general include credit card debt and medical bills. With proper planning, you may be able to keep your house or car. There are, however, some limitations. Some debts (such as student loan debt or tax debt) in general cannot be wiped out. Also, you must fall beneath a certain income threshold to qualify for chapter 7. Every situation is unique and there are exceptions to every rule. There is no substitute for individual attention to each case, and personalized legal service.
  • Chapter 13: Chapter 13 bankruptcy can be extremely useful. This form of debt relief allows you to consolidate your debts into a repayment plan with payment terms you can afford. If any debt is left at the end of your repayment plan, that debt could be discharged by the bankruptcy court. In some cases, chapter 13 can be used to stop a mortgage foreclosure, or automobile repossession, and give you time to get caught up on your payments. Here again, the rules are complex, and there are exceptions to every rule. That is why we look carefully at each client's individual situation, and help find a solution that is best for you.
